Facial Recognition Terms and Consent

Welcome to MICEtribe (“Company”, “we”, “our”, “us”). By accessing or using our Services, systems, or products, you (“User”) agree to be bound by these Terms and Conditions (“Agreement”). This Agreement applies to Organizers, Clients, Attendees, and temporary Crew members. Please read it carefully.

1. Purpose of this Consent

Contacless.IO OÜ and its subsidiaries and sister companies, (collectively, the “Company”) are introducing facial recognition technology as part of their ticketing, registration and event access solutions. This technology is intended to facilitate and streamline the registration and ticket verification process and to assist in verifying the identity of individuals attending events and exhibitions for which they have completed the relevant registration.

2. Personal Data and Facial Data

• As part of the use of the facial recognition technology, The Company and the relevant technology provider may collect and process certain personal data relating to individuals who register for or attend the relevant events and exhibitions, which may include:
• Name and registration details;
• Email address;
• Phone number;
• Ticket and event registration information;
• Information relating to the event or exhibition for which the individual has registered;
• Facial image
• Facial recognition data or a biometric representation/template generated from the facial image, if and to the extent generated by the technology; and
• Any other personal data that may be required to complete the registration.

The technology may analyse certain characteristics of an individual’s face and compare them with the individual’s relevant registration, ticket or other information associated with the relevant event or exhibition in order to verify the individual’s identity and facilitate ticket verification and access.

3. Purpose of Processing

The Company expressly collect and process personal data and facial data for the following purposes:

1. Facilitating and streamlining registration for events and exhibitions;
2. Associating facial data with the relevant registration and/or ticket information;
3. Verifying the individual’s identity in connection with the individual’s registration and ticket;
4. Verifying that the individual is the person registered to attend the relevant event or exhibition;
5. Facilitating and streamlining ticket verification and the admission process;
6. Facilitating access to events and exhibitions for which the individual has successfully completed the relevant registration; and
7. Demonstrating and evaluating the functionality of the facial recognition technology.

Users consent to the use of their data in accordance with MICEtribe’s Privacy Policies.

4. Data Sharing and Technology Provider

The Company may use authorized service providers to provide and operate the facial recognition technology. Accordingly, relevant personal data and facial data may be processed by authorized service providers to the extent necessary to provide, operate, maintain and support the facial recognition technology and the ticketing and registration services. Such processing shall be subject to the applicable contractual, technical, security and data protection requirements governing the relevant processing activities.

5. Withdrawal of Consent

Where the processing of personal data and facial data is based on consent, an individual may withdraw such consent at any time by contacting:

Following the withdrawal of consent, further processing of the individual’s facial data for the purposes based on such consent will cease, subject to any processing that is otherwise permitted or required under applicable law

Withdrawal of consent will not affect the lawfulness of any processing carried out before the withdrawal of consent.

6. Data Protection Rights 

Subject to applicable data protection laws, individuals may have rights relating to their personal data, including the right to:

• Access and review their personal data;
• Request a copy of their personal data, where applicable;
• Request correction of inaccurate personal data;
• Withdraw their consent;
• Object to certain processing; and
• Request deletion of their personal data where applicable.

7. Data Security

Appropriate technical and organizational measures will be implemented to protect personal data and facial data against unauthorized access, disclosure, alteration or other unlawful processing.

8. Data Retention and Deletion

The Company will retain facial data and any facial recognition data or biometric representation/template generated from the facial image only for as long as necessary to provide and complete the facial recognition services for the relevant event or exhibition. Following the completion of the relevant event or exhibition, the Company will delete the facial data and any facial recognition data or biometric representation/template generated for the purposes of the facial recognition service.

9. Optional Use of Facial Recognition

The use of facial recognition technology is optional. Individuals who choose to use the facial recognition technology may benefit from a faster and more streamlined registration and event access process, including self check-in and the ability to print their event badge directly through the facial recognition-enabled registration process. Individuals who do not wish to use the facial recognition technology may complete their registration and access the relevant event or exhibition using the standard registration and ticket verification process made available by the Company for the relevant event or exhibition.

10. Electronic Acknowledgment and Consent

By selecting the checkbox below and clicking “I Agree”, “Accept”, or any equivalent electronic confirmation button, I confirm that:

• I have read and understood this Consent and Acknowledgment;
• I understand the nature and intended use of the facial recognition technology;
• I understand that my facial image and, where applicable, facial recognition data or a biometric representation/template may be processed;
• I understand the purposes for which my personal data and facial data will be processed;
• I understand that the technology may be used to facilitate registration, ticket verification and access to events and exhibitions for which I have registered;
• I acknowledge that I have been provided with access to the applicable MICEtribe Privacy Policy and Terms and Conditions of Use;
• I acknowledge that I have read and understood the applicable MICEtribe Privacy Policy and agree to the applicable Terms and Conditions of Use; and
• I expressly consent to the collection and processing of my personal data and facial data, including my facial image and, where applicable, facial recognition data or a biometric representation/template, for the purposes described in this Consent and Acknowledgment.

By using the face recognition feature, you acknowledge that you have read and understood, and expressly agree to, the above Face Recognition and Biometric Terms and consent, including the collection and processing of your personal data and facial data, including your facial image and, where applicable, facial recognition data or a biometric representation/template, for the purposes described above.

Electronic Consent Record

For record and audit purposes, The Company may maintain an electronic record of:

• The identity or account associated with the consent;
• The date and time the consent was provided;
• The version of this Consent and Acknowledgment accepted;
• The method by which consent was provided; and
• Other information reasonably necessary to demonstrate and document the consent.
